Memo: Hemming (1967) stated:- Apart from Kluk (1802), of whose work Kirby and his contemporaries were unaware, Kirby was the first author to publish in a strictly binominal form the intermediate term Plebejus (spelled Plebeius by Kirby) rejected by the Commission in its Opinion 124 as not possessing the status of a subgeneric name as of Linnaeus (1758). Kirby in the appendix to his Syn. Cat. applied the name Plebeius to the enormous assemblage (329 species) of Lycaenids which in his main text he had placed in the genus Cupido Schrank, 1801. Previous to the adoption of the "One-Letter-Difference" Rule now embodied in Article 56 (a) of the Code, Plebeius Kirby, 1871, would have been considered a homonym of the name Plebejus Kluk, 1802, and, as the later-published of the two names, would have been rejected under the Law of Homonymy. Although now not invalid under the foregoing Law, the name Plebeius Kirby is invalid, as it is a junior objective synonym of Plebejus Kluk. The higher classification used here follows Lamas (2008).
